FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

May 9, 2023

TO:
Honorable Robert Nichols, Chair, Senate Committee on Transportation

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB3156 by Leach (Relating to liability of engineers and certain business entities performing construction monitoring and inspection services for the Texas Department of Transportation.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to add a new section limiting the liability in personal injury and property damage cases for a business entity, an officer or employee of a business entity, or an engineer that provides monitoring and inspection services to the Texas Department of Transportation (TxDOT) as a consultant or subconsultant to monitor and inspect transportation construction or maintenance project work performed by a contractor.

Based on the information provided by TxDOT and the Office of Court Administration, it is assumed the bill would not result in a significant operational or fiscal impact to the State or the state court system.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
