LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

April 7, 2023

TO:
Honorable Jeff Leach, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB3156 by Leach (relating to liability of professional firms performing construction monitoring and inspection services for the Texas Department of Transportation.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practice and Remedies Code to add a new section limiting the liability in personal injury and property damage cases for professional firms, and officers or employees of professional firms, that provide monitoring and inspection services to the Texas Department of Transportation (TxDOT) as a consultant or subconsultant to TxDOT to monitor and inspect transportation construction or maintenance project work performed by a contractor.

Based on the information provided by TxDOT and the Office of Court Administration, it is assumed the bill would not result in a significant operational or fiscal impact to the State or the state court system.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
