There would be an indeterminate cost to implement recycling and waste reduction programs that would be created under the provisions of the bill.

The bill would amend Health and Safety Code by adding Chapter 375, which creates the Texas Cleaner Landscapes for the Economy, Agriculture and Nature (CLEAN) Advisory Council. The Council would be required to develop and implement a program to reduce litter and develop a carryout bag recycling and reduction program. The Council would also be required to create and implement a program that recovers 85 percent of plastic, glass, and aluminum containers sold in the state and to determine how the money generated from the program would be best used for purposes of the chapter. The bill would authorize the Council to create civil penalties to deter fraud and abuse of the program.  

The cost associated with the development and implementation of two new programs is unknown. Additionally, the creation of new civil penalties could increase state revenue, but the number of offenses and amount of civil reimbursement are unknown. As such, the fiscal implications of the bill cannot be determined.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
