LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

April 13, 2023

TO:
Honorable Terry Canales, Chair, House Committee on Transportation

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB3741 by Canales (relating to the operation of a program by the Texas Department of Transportation to allow a real property owner to plant or replace vegetation in a right-of-way.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to require the Texas Department of Transportation (TxDOT) to develop and implement a program to allow an owner of real property abutting or adjoining property acquired by TxDOT, for the right-of-way of a road in the state highway system, to plant new vegetation or replace existing vegetation.

Based on the information provided by TxDOT, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the department's existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
