LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

May 2, 2023

TO:
Honorable J. M. Lozano, Chair, House Committee on Urban Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB5255 by Lopez, Ray (relating to the collection and publication of affordable housing information by certain municipalities and the Texas Department of Housing and Community Affairs.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would require certain municipalities to conduct annual surveys of all affordable housing units located in the municipality. Certain information about each affordable housing unit would be required to be made publicly available via a searchable database on an Internet website and a mobile application. Certain municipalities would be required to make this affordable housing data available to state agencies upon request. The bill would require the Texas Department of Housing and Community Affairs to adopt rules necessary to implement and administer these provisions.

Local Government Impact

There could be costs to certain municipalities related to conducting the annual surveys the bill would require, as well as costs associated with creating or maintaining databases, Internet websites, and mobile applications.
