LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

March 15, 2023

TO:
Honorable Bryan Hughes, Chair, Senate Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB250 by Hall (Relating to the provision of and professional liability insurance coverage for gender transitioning or gender reassignment medical procedures and treatments for certain children.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would provide the Texas Medical Board, or another state regulatory agency with jurisdiction over a health care provider, the authority to revoke the license, certification, or authorization of a physician or health care provider who has violated the bill's provisions. The bill would amend the Insurance Code to prohibit a professional liability insurance policy from covering damages assessed relating to section one of this bill.

According to the Texas Medical Board, increases in the number of complaints relating to the revoking of licenses, certifications, or authorizations of a physician or health care provider who has violated the bill's provisions cannot be estimated; however, this estimate assumes costs to the state will be minimal and no significant fiscal impact to the state is anticipated.

Based on the analysis of the Department of Insurance and Health and Human Services Commission, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
