LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

March 27, 2023

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB386 by Hall (Relating to the prosecution of a capital murder committed against a peace officer or fireman.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would establish a presumption for purposes of capital murder against a peace officer or fireman that an actor knew the person was a peace officer or fireman if the person was wearing a distinctive uniform or badge or made an identification as a peace officer or fireman to the actor. It is assumed that any fiscal impact and any impact on state correctional populations or on the demand for state correctional resources would not be significant.

Local Government Impact

It is assumed that any fiscal impact to units of local government associated with enforcement, prosecution, supervision, or confinement would not be significant.
