No significant fiscal implication to the State is anticipated.
The bill would provide for civil liabilities against a physician or health care provider who provides certain medical procedures related to this bill. The bill would amend the Insurance Code to prohibit coverage by a health benefit plan for certain medical procedures related to this bill. The bill would amend the Government Code to prohibit a government entity of this state from using public funds for certain medical procedures related to this bill.
According to the Employees Retirement System, the prohibition of certain medical procedures related to this bill may conflict with federal law. A determination by the federal government that this state is out of compliance with federal provisions could result in enforcement actions and potential loss of federal funds.
Based on the analysis of the Teacher Retirement System of Texas, Employees Retirement System, Department of Insurance, Health and Human Services Commission, Texas A&M University System Administrative & General Offices, and the University of Texas System Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
