LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 88TH LEGISLATIVE REGULAR SESSION

April 3, 2023

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SJR51 by Parker (Proposing a constitutional amendment authorizing the legislature to enact laws providing for the denial of bail to a person accused of committing a trafficking or sexual offense against a child while released on bail for committing a similar offense.), As Introduced

No significant fiscal implication to the State is anticipated, other than the cost of publication.

The cost to the state for publication of the resolution is $204,406.

It is assumed that any costs associated with the resolution could be absorbed using existing resources.

Local Government Impact

The fiscal implications of the bill cannot be determined for units of local government at this time. Based on information provided by the Office of Court Administration, the denial of bail to certain defendants could result in more defendants being detained locally pending trial, which may have a fiscal impact for local governments. However, the increased number of defendants that would be detained locally is unknown.
