LEGISLATIVE BUDGET BOARD

CRIMINAL JUSTICE IMPACT STATEMENT

88TH LEGISLATIVE REGULAR SESSION

April 11, 2023

TO:
Honorable Terry Canales, Chair, House Committee on Transportation

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB648 by Gervin-Hawkins (Relating to the enforcement of the prohibition on passing a school bus using images from a school bus monitoring system.), As Introduced

The bill would authorize a local authority or school district to issue a civil or criminal charge or citation for passing a school bus based on an image from a school bus monitoring system and would allow for use of the recorded image as evidence in a proceeding for such a violation.

Expanding the enforcement of an existing offense may result in additional demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement.

In fiscal year 2022, there were no individuals arrested, placed on community supervision, or admitted into a state correctional institution for an offense related to passing a school bus.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
