CRIMINAL JUSTICE IMPACT STATEMENT

88TH LEGISLATIVE REGULAR SESSION

March 27, 2023

TO:
Honorable Joe Moody, Chair, House Committee on Criminal Jurisprudence

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
HB1362 by Wu (Relating to the punishment for a capital felony committed by an individual younger than 21 years of age.), As Introduced

The bill would change the applicability of capital felony punishments for an individual younger than 21 at the time of the offense.

In fiscal year 2022, there were 12 individuals admitted into a state correctional institution for a capital felony punishable by death, life without parole, or a capital life sentence who were younger than 21 at the time of the offense.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
