HB1769 by Meyer (Relating to the statute of limitations for certain offenses committed against children.), As Engrossed

The bill would increase the limitations period for indictments to be presented for certain offenses related to trafficking of children and sexual performance by a child to 20 years after the 18th birthday of the victim and would increase the limitations period for indictments to be presented for the offense of possession or promotion of child pornography to 7 years after the date of the commission of the offense.

Extending the limitations period for indictments to be presented for an existing offense may result in additional demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement.

In fiscal year 2022, there was one individual arrested and no individuals placed or admitted to adult community supervision, juvenile probation supervision, an adult state correctional institution, or a juvenile state correctional institution for trafficking of persons offenses specified by the bill.

In fiscal year 2022, there were 63 individuals arrested, 10 individuals placed on adult community supervision, 2 individuals placed on juvenile probation supervision, 17 individuals admitted to an adult state correctional institution, and no individuals admitted to a juvenile state correctional institution for the offense of sexual performance by a child.

In fiscal year 2022, there were 584 individuals arrested, 129 individuals placed on adult community supervision, 46 individuals placed on juvenile probation supervision, 209 individuals admitted to an adult state correctional institution, and 1 individual admitted to a juvenile state correctional institution for possession or promotion of child pornography.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
