The bill would increase the limitations period for indictments to be presented for certain offenses related to trafficking of children from 10 years after the 18th birthday of the victim to 20 years after the 18th birthday of the victim. The bill would establish the limitations period for indictments to be presented for the offense of sexual performance by a child as 20 years after the 18th birthday of the victim regardless of the victim's age at the time the offense is committed.

Extending the limitations period for indictments to be presented for an existing offense may result in additional demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement.

In fiscal year 2022, there was one individual arrested and no individuals placed or admitted to adult community supervision, juvenile probation supervision, an adult state correctional institution, or a juvenile state correctional institution for trafficking of persons offenses specified by the bill.

In fiscal year 2022, there were 63 individuals arrested, 10 individuals placed on adult community supervision, 2 individuals placed on juvenile probation supervision, 17 individuals admitted to an adult state correctional institution, and no individuals admitted to a juvenile state correctional institution for the offense of sexual performance by a child.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
