Honorable Abel Herrero, Chair, House Committee on Corrections
FROM:
Jerry McGinty, Director, Legislative Budget Board
IN RE:
HB2328 by Wu (Relating to the medical release of certain terminally ill defendants.), As Introduced
The bill would define "terminally ill" for purposes of state jail felony community supervision medical release as having an incurable illness or condition that is expected to result in death within one year regardless of life-sustaining treatment.
It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
