LEGISLATIVE BUDGET BOARD

CRIMINAL JUSTICE IMPACT STATEMENT

88TH LEGISLATIVE REGULAR SESSION

April 11, 2023

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB1346 by Miles (Relating to the prosecution of certain littering offenses.), As Introduced

The bill would make certain provisions related to preparatory offenses applicable to certain illegal dumping. The penalty for such an offense would vary and be dependent on the conduct of the offense.

Expanding conduct constituting an offense may result in additional demands upon state and local correctional resources due to a possible increase in the number of individuals placed under supervision in the community or sentenced to a term of confinement.

In fiscal year 2022, there were 546 individuals arrested, 47 individuals placed on community supervision, and 3 individuals admitted into a state correctional institution for illegal dumping.

It is assumed that any impact on state correctional populations or on the demand for state correctional resources would not be significant.
