Pursuant to an announcement from the house floor on May 10, 2023, and permission granted on May 1, 2023, to meet while the House was in session for the remainder of the session, the House Committee on General Investigating met in a formal meeting and was called to order by the chair, Representative Murr, at 6:04 p.m.

The initial quorum call was answered as follows: Representatives Murr; Johnson, Ann; Geren; Longoria; and Spiller.

A quorum was present.

Without objection, the committee entered into executive session under Subchapter B, Chapter 301, Government Code, the Rules of Procedure of the House of Representatives, the Housekeeping Resolution, and the committee’s rules.

The committee exited the executive session. No decisions were made or voted on during the executive session.

At 6:18 p.m., on the motion of the chair and without objection, the meeting was recessed until 6:45 p.m., May 10, 2023.

The committee reconvened at 6:46 p.m. and was called to order by the chair, Representative Murr.

The quorum call was answered as follows: Representatives Murr; Johnson, Ann; Geren; Longoria; and Spiller.

A quorum was present.

The committee exited the executive session. No decisions were made or voted on during the executive session.

Representative Geren offered the following motion in writing:

Mr. Chairman:

Pursuant to Rule 4, Section 21(a), of the House Rules of Procedure, and Section 301.024(a), Government Code, I move as follows:

(1) The committee finds that it has been apprised in executive session of the subject matter of the inquiry in MATTER A and the identity of each person or entity to whom a subpoena is to be issued; that anonymized process is necessary to ensure the integrity of its inquiry in MATTER A and prevent reprisal and retaliation against the subpoenaed individuals; and that there is no alternative to anonymized process to accomplish this purpose.

(2) The issuance of subpoenas is authorized in MATTER A as follows:

(A) ENTITY #1, to provide all relevant testimony and information concerning the committee's inquiry; and

(B) ENTITY #2, to provide all relevant testimony and information concerning the committee's inquiry; and

(D) ENTITY #4, to provide all relevant testimony and information concerning the committee's inquiry; and

(E) ENTITY #5, to provide all relevant testimony and information concerning the committee's inquiry; and

(F) ENTITY #6, to provide all relevant testimony and information concerning the committee's inquiry; and

(G) ENTITY #7, to provide all relevant testimony and information concerning the committee's inquiry; and

(H) JOHN DOE #5, to provide all relevant testimony and information concerning the committee's inquiry.

(3) The committee chair is directed to issue the process authorized by this motion in a form acceptable to the chair. The committee chair may issue one or more subpoenas for a part or portion of any relevant testimony or information as necessary to avoid overburdening a witness or the committee.

(4) The committee chair is authorized to appoint, on the committee's behalf, a sergeant-at-arms or an agent to serve the authorized process.

The motion prevailed by the following record vote:

Ayes: Representatives Murr; Johnson, Ann; Geren; Longoria; Spiller (5).

Nays: None (0).

Present, Not Voting: None (0).

Absent: None (0).

At 7:11 p.m., on the motion of the chair and without objection, the meeting was adjourned subject to the call of the chair.
