Pursuant to a notice posted on April 6, 2023, the House Committee on Transportation met in a public hearing and was called to order by the chair, Representative Canales, at 12:47 p.m.
The initial quorum call was answered as follows: Representatives Canales; Raney; Ashby; Gamez; Harris, Caroline; Lozano; Lujan; Ordaz; Patterson; Perez; and Romero, Jr..
A quorum was present.
The chair directed that the April 5, 2023 minutes for the House Committee on Transportation be corrected. The corrected minutes were authorized without objection.
The chair appointed a Subcommittee on Discretionary Funding Allocations which consists of 3 Members.
The chair named the following members to the subcommittee on Discretionary Funding Allocations: Representative Davis, Chair; Representatives Harris, Caroline; and Lujan.
The responsibilities of the Subcommittee include the following:
Verifying the March 1, 2023 testimony of the Executive Director of the Texas Department of Transportation (“TXDOT”) before the House Transportation Committee that TXDOT has allocated 20% of its funding for the 2024 Unified Transportation Program (the “UTP”) to Category 12 – Commission Strategic Priorities (“Category 12”).
Reviewing TXDOT’s progress regarding the Texas Clear Lanes Program, delineated between Texas Clear Lanes-eligible metropolitan regions, non-Texas Clear Lanes-eligible metropolitan regions and rural areas of the State.
Reviewing other methodologies that TXDOT uses when determining allocations between categories of the UTP.
Determining whether TXDOT has complied with the requirement set forth in Texas Transportation Code, Section 201.999(d) (HB 20, 84th Regular Legislative Session), that TXDOT may make discretionary funding decisions for no more than 10% of the current biennial budget of the department.
Reviewing any publicly available information that TXDOT used or relied upon in arriving at the amount allocated to Category 12, and to determine whether TXDOT has complied with Section 201.9991(d).
Making recommendations to the full Committee on the issue of whether the 10% limitation set forth in the Section 201.9991(d) or some other limit on discretionary spending should also be applied to the UTP or to Category 12.
Preparing a written report to the full Committee outlining the Subcommittee’s findings.
