Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Border Security was held on Tuesday, June 6, 2023, in the Capitol Extension, Room E1.016, at Austin, Texas.

The chair called the meeting to order at 8:30 AM. The following members arrived after the roll

was called: Senator King. There being a quorum present, the following business was transacted:

 

The chair laid out SB 5 and the House companion HB 2 and recognized the author/sponsor, Senator Flores, to explain the bills.

 

Witnesses testifying and registering on the bills are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Flores moved that SB 5 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 4 ayes, 1 nay, 0 present not voting, and 0 absent.

 

At 9:30 AM Senator Flores assumed the chair.

 

The chair laid out SB 2 and recognized the author, Senator Birdwell, to explain the bill.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Birdwell moved that SB 2 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 2 nays, 0 present not voting, and 0 absent.

 

The chair laid out SB 8 and recognized the author, Senator Birdwell, to explain the bill.

 

Witnesses testifying and registering on the bill are shown on the attached list.

 

The chair moved that the public testimony be closed; without objection, it was so ordered.

 

Senator Birdwell moved that SB 8 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 2 nays, 0 present not voting, and 0 absent. 

 

At 10:08 AM Senator Birdwell resumed the chair.

 

Senator Birdwell moved that HB 2 be left pending; without objection, it was so ordered.

 

At 10:09 AM Senator Birdwell moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.

 

Pursuant to a motion made by Senator Birdwell to suspend the following Senate Rules 11.10, 11.13, and 11.18, the Senate Committee on Border Security reconvened in the Senate Press Room 2E.9.

 

At 6:44 PM Senator Birdwell reconvened the meeting, the roll was called and a quorum was present.

 

The chair laid out as a matter of pending business HB 2.

 

Senator Flores sent up a committee substitute.  The chair recognized Senator Flores to explain the difference between the committee substitute and the house bill as engrossed.  Senator Flores moved the adoption of the committee substitute; without objection, it was so ordered.

 

Senator Flores moved that HB 2 do not pass but that CSHB 2 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 3 ayes, 1 nay, 1 present not voting, and 0 absent.

 

There being no further business, at 6:46 PM Senator Birdwell moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
