Amend CSHB 23 (house committee printing) by adding the following appropriately numbered SECTION to the bill and renumbering subsequent SECTIONS of the bill accordingly:
SECTION ____. Chapter 247, Local Government Code, as added by Chapter 654 (HB 14), Acts of the 88th Legislature, Regular Session, 2023, is amended by adding Section 247.007 to read as follows:
Sec. 247.007. AUTHORIZED REGULATORY AUTHORITY DISAPPROVAL OF LAND DEVELOPMENT. A regulatory authority may disapprove land development for which a person is reviewing a development document or performing a development inspection under Section 247.002 if:
(1) the regulatory authority believes that the fundamental constitutional rights of persons in the area of the development is being violated by the approval of the development; or
(2) the applicant or owner of the land or improvement that is the subject of a development inspection is under investigation by the attorney general, a county attorney, or a district attorney.
