Amend CSHB 23 (house committee printing) by adding the following appropriately numbered SECTION to the bill and renumbering subsequent SECTIONS of the bill accordingly:
SECTION ____. Chapter 247, Local Government Code, as added by Chapter 654 (HB 14), Acts of the 88th Legislature, Regular Session, 2023, is amended by adding Section 247.0021 to read as follows:
Sec. 247.0021. EXCEPTION FOR HIGH-COMPLEXITY PROJECTS. Notwithstanding Section 247.002, a regulatory authority may require a direct development document review or development inspection of and a person may not perform a review or inspection under Section 247.002 for a development project that:
(1) involves a drainage facility;
(2) includes hazardous materials storage or transmission infrastructure;
(3) exceeds 100 acres in size; or
(4) is designated by the regulatory authority as requiring a higher tier of public oversight due to safety or environmental risk.
