Amend CSHB 138 (house committee printing) as follows:
(1) Strike page 5, line 22, through page 6, line 3, and substitute the following:
Sec. 38.455. FUNDING OF ANALYSIS PROGRAM; FEE. (a) The comptroller shall assess an annual fee on each health maintenance organization and insurer offering health benefit plans subject to Chapter 843 or 1301 in the amount necessary to implement this subchapter.
(2) Reletter subsequent subsections of added Section 38.455, Insurance Code, accordingly.
(3) Add the following appropriately numbered SECTION to the bill and renumber subsequent SECTIONS of the bill accordingly:
SECTION ____. The Center for Health Care Data at The University of Texas Health Science Center at Houston is required to implement a provision of this Act only if the legislature appropriates money specifically for that purpose. If the legislature does not appropriate money for that purpose, the center may, but is not required to, implement a provision of this Act using other money available for that purpose.
