Amend HB 2761 (house committee report) by adding the following appropriately numbered SECTION to the bill and renumbering subsequent SECTIONS of the bill accordingly:
SECTION ____. Section 43.05, Penal Code, is amended by adding Subsection (e) to read as follows:
(e) It is not a defense to prosecution under Subsection (a)(2) or (3) that the child or disabled individual:
(1) lacks the culpable mental state to engage in the act of prostitution; or
(2) did not complete the act of prostitution.
