Amend CSHB 3211 (house committee report) as follows:
(1) On page 7, line 17, strike "The changes in law made by this Act apply" and substitute "Subchapter D, Chapter 1451, Insurance Code, as amended by this Act, applies".
(2) Add the following appropriately numbered SECTIONS to the bill and renumber the SECTIONS of the bill accordingly:
SECTION ____. Subchapter F, Chapter 540, Government Code, is amended by adding Section 540.0281 to read as follows:
Sec. 540.0281. REIMBURSEMENT OF EYE HEALTH CARE SERVICES PROVIDERS. A contract to which this subchapter applies must require that the contracting Medicaid managed care organization require any insurer, health maintenance organization, third-party administrator, managed care plan, vision plan, or other plan or entity the organization contracts with, offers, owns, or otherwise engages to provide or arrange for the provision of eye health care or vision care services under the managed care plan the Medicaid managed care organization offers to reimburse an eye health care services provider who provides services to a recipient under the plan at a rate that is at least equal to 95 percent of the Medicaid fee-for-service rate for the provision of the same or similar services.
SECTION ____. (a) The Health and Human Services Commission shall, in a contract between the commission and a managed care organization under Chapter 540, Government Code, that is entered into or renewed on or after the effective date of this Act, require that the managed care organization comply with Section 540.0281, Government Code, as added by this Act.
(b) The Health and Human Services Commission shall seek to amend contracts entered into with managed care organizations under Chapter 533 or 540, Government Code, before the effective date of this Act to require those managed care organizations to comply with Section 540.0281, Government Code, as added by this Act. To the extent of a conflict between those provisions of law and a provision of a contract with a managed care organization entered into before the effective date of this Act, the contract provision prevails.
SECTION ____. If before implementing any provision of this Act a state agency determines that a waiver or authorization from a federal agency is necessary for implementation of that provision, the agency affected by the provision shall request the waiver or authorization and may delay implementing that provision until the waiver or authorization is granted.
