Amend HB 4166 (house committee printing) as follows:
(1) On page 2, line 12, strike "Section 156.202(a-1), Finance Code, is amended" and substitute "Section 156.202, Finance Code, is amended by amending Subsections (a-1) and (b) and adding Subsection (a-3)".
(2) On page 3, line 5, between "(4)" and "an", insert "except as provided by Subsection (a-3),".
(3) On page 3, between lines 20 and 21, insert the following:
(a-3) An owner of residential real estate is not eligible for an exemption under Subsection (a-1)(4) if the owner is, or is an employee or contractor of an entity that is:
(1) under indictment for any crime involving the marketing, sale, or transfer of residential real estate;
(2) under known investigation by any law enforcement agency, prosecuting attorney, or the attorney general, for any crime involving the marketing, sale, or transfer of residential real estate; or
(3) a defendant to any civil or administrative action brought by the United States, this state, or any political subdivision of this state, including the attorney general, alleging a violation of state or federal law involving the marketing, sale, or transfer of residential real estate.
(b) In determining eligibility for an exemption under Subsection (a-1)(3) or (4), two or more owners of residential real estate are considered a single owner for the purpose of computing the number of mortgage loans made within the period specified by that subdivision if any of the owners are an entity or an affiliate of an entity, including a general partnership, limited partnership, limited liability company, or corporation, as defined by Section 1.002, Business Organizations Code.
(4) On page 3, line 21, strike "Section 180.003(a), Finance Code, is amended" and substitute "Section 180.003, Finance Code, is amended by amending Subsections (a) and (d) and adding Subsection (a-1)".
(5) On page 4, line 24, between "(7)" and "an", insert "except as provided by Subsection (a-1),".
(6) On page 5, between lines 2 and 3, insert the following:
(a-1) An owner of residential real estate is not eligible for an exemption under Subsection (a)(7) if the owner is, or is an employee or contractor of an entity that is:
(1) under indictment for any crime involving the marketing, sale, or transfer of residential real estate;
