Amend CSHB 5265 (house committee report) as follows:
(1) On page 2, line 16, strike "by the comptroller and administered" and substitute "and administered by the comptroller and invested".
(2) On page 2, between lines 17 and 18, insert the following appropriately lettered subsection and reletter subsequent subsections accordingly:
(____) The expenses of managing the fund shall be paid from the fund.
(3) On page 2, strike lines 18 and 19 and substitute the following appropriately lettered subsection:
(____) The trust company shall invest the fund in accordance with Section 21, Article VII, Texas Constitution. Money in the fund may be invested with the state treasury pool.
(4) On page 4, line 24, between "comptroller" and "shall", insert ", in consultation with the coordinating board,".
(5) On page 6, line 17, strike "DETERMINATION" and substitute "ALLOCATION".
(6) On page 6, strike lines 20 through 22 and substitute the following appropriately numbered subdivision:
(____) allocate to each eligible institution the amount of each distribution from the fund to which the institution is entitled as provided by this subchapter; and
(7) On page 6, line 23, strike "determinations" and substitute "allocations".
