Amend SB 17 on third reading, in the SECTION of the bill adding Subchapter H, Chapter 5, Property Code, as follows:
(1)  Strike added Section 5.255(b), Property Code (as renumbered on second reading by Amendment No. 14 by Schatzline), and substitute the following:
(b)  If the attorney general determines that an investigation of a purchase or acquisition of an interest in real property is warranted under this section, the attorney general shall:
(1)  serve the person who purchased or acquired the interest in the real property with written notice stating:
(A)  that the attorney general has opened an investigation into the purchase or acquisition of the interest;
(B)  the detailed allegations that are the basis of the investigation; and
(C)  the evidence against the person; and
(2)  investigate the purchase or acquisition of the interest and determine whether a violation of this subchapter occurred.
(2)  Immediately following added Section 5.257(a), Property Code (as renumbered on second reading by Amendment No. 14 by Schatzline), insert the following appropriately lettered subsection and reletter subsequent subsections and cross-references to those subsections accordingly:
(____)  In an action brought by the attorney general under this subchapter:
(1)  the court may not enter an order or make a referral under Subsection (a) unless the attorney general proves by clear and convincing evidence that the interest in the real property that is the subject of the action was purchased or acquired in violation of this subchapter; and
(2)  the person who purchased or acquired the interest in real property that is the subject of the action is entitled to a trial by jury.
