Amend SB 686 (senate committee report) as follows:
(1)  In SECTION 3 of the bill, strike amended Section 25.036(a), Education Code (page 1, lines 50 through 59), and substitute the following:
(a)  Any child, other than a high school graduate, who is younger than 21 years of age and eligible for enrollment on September 1 of any school year may apply to transfer [annually] from the child's school district or district campus [of residence] to another school district in this state or another campus located in the child's district, as applicable, selected by the child's parent or guardian that offers the appropriate grade level and has capacity, as determined under Section 25.046 [if both the receiving district and the applicant parent or guardian or person having lawful control of the child jointly approve and timely agree in writing to the transfer].
(2)  In SECTION 3 of the bill, in added Section 25.036(m), Education Code (page 3, lines 39 and 40), strike "student must" and substitute "district may require the student to".
(3)  In SECTION 3 of the bill, in added Section 25.036(n), Education Code (page 3, line 45), immediately following "district,", insert "or a student who is not enrolled in the district but resides in the district's attendance zone".
(4)  In SECTION 4 of the bill, in added Section 25.046(a), Education Code (page 4, lines 1 and 2), strike "each year on the first day of January, April, July, and October" and substitute "before the beginning of each semester".
(5)  In SECTION 4 of the bill, in added Section 25.046(a), Education Code (page 4, line 13), between "district" and "shall", insert "may consider the number of staff employed by the campus and".
(6)  In SECTION 4 of the bill, in added Section 25.046(d), Education Code (page 4, line 37), strike "include".
(7)  In SECTION 4 of the bill, in added Section 25.046(d)(1), Education Code (page 4, line 38), between "(1)" and "adoption", insert "include the".
(8)  In SECTION 4 of the bill, in added Section 25.046(d)(2), Education Code (page 4, line 39), between "(2)" and "the", insert "include".
(9)  In SECTION 4 of the bill, in added Section 25.046(d)(2), Education Code (page 4, line 42), strike "and".
(10)  In SECTION 4 of the bill, in added Section 25.046(d)(3), Education Code (page 4, line 43), between "(3)" and "the", insert "include".
(11)  In SECTION 4 of the bill, in added Section 25.046(d), Education Code (page 4, line 45), between "community" and the underlined period, insert the following:
; and
(4)  prioritize:
(A)  flexibility of access for students;
(B)  encouraging schools in the district to accommodate student transfers; and
(C)  preventing schools in the district from discouraging student transfers
(12)  In SECTION 4 of the bill, in added Section 25.046(f), Education Code (page 4, line 52), strike "required" and substitute "model".
(13)  In SECTION 4 of the bill, in added Section 25.046(f), Education Code (page 4, lines 53 through 60), strike the following:
In adopting rules to implement this section, the commissioner shall consider feedback from districts and shall prioritize:
(1)  flexibility of access for students;
(2)  encouraging districts to accommodate student transfers; and
(3)  preventing districts from discouraging student transfers.
(14)  In SECTION 4 of the bill, in added Section 25.047(a)(1), Education Code (page 4, line 67), strike "quarterly".
(15)  Add the following appropriately numbered SECTIONS to the bill and renumber subsequent SECTIONS of the bill accordingly:
SECTION ____.  Section 12A.004(a), Education Code, is amended to read as follows:
(a)  A local innovation plan may not provide for the exemption of a district designated as a district of innovation from the following provisions of this title:
(1)  a state or federal requirement applicable to an open-enrollment charter school operating under Subchapter D, Chapter 12;
(2)  Subchapters A, C, D, and E, Chapter 11, except that a district may be exempt from Sections 11.1511(b)(5) and (14) and Section 11.162;
(3)  student transfer and admission requirements under Sections 25.001, 25.036, 25.046, and 25.047;
(4)  state curriculum and graduation requirements adopted under Chapter 28; and
(5) [(4)]  academic and financial accountability and sanctions under Chapters 39 and 39A.
SECTION ____.  Section 12A.004(a), Education Code, as amended by this Act, applies to each local innovation plan adopted under Chapter 12A, Education Code, regardless of whether the plan was adopted before, on, or after the effective date of this Act. A local innovation plan adopted or renewed before the effective date of this Act must comply with Section 12A.004(a), Education Code, as amended by this Act, not later than September 1, 2025.
SECTION ____.  The changes in law made by this Act may not be interpreted to affect the Interstate Compact on Educational Opportunity for Military Children executed under Section 162.002, Education Code.
