Amend SB 875 (senate committee report) as follows:
(1)  In SECTION 1 of the bill, in amended Section 11.169, Education Code (page 1, lines 28 and 29), between "(a)" and "Notwithstanding", insert the following:
In this section, "electioneer" means to engage in an act intended to support or oppose a specific candidate, measure, or political party.
(b)
(2)  In SECTION 1 of the bill, in amended Section 11.169, Education Code (page 1, lines 34 and 35), strike "for or against any candidate, measure, or political party" and substitute "[for or against any candidate, measure, or political party]".
(3)  In SECTION 1 of the bill, in amended Section 11.169, Education Code (page 1, line 36), strike "(b)" and substitute the following:
(c)  It is an exception to the application of this section that the member of the board of trustees:
(1)  used a district facility to host a forum for political candidates or to hold a political party convention;
(2)  used the facility as described by Subdivision (1) at a time that was not during the period between the first day of early voting and the date of the election, if the facility was used as an early voting or election day polling place; and
(3)  allowed equally all candidates for the same office or all political parties, as applicable, the opportunity to use the facility as described by Subdivision (1).
(d)
(4)  In the recital to SECTION 2 of the bill (page 1, line 38), strike "Subsections (f) and (g)" and substitute "Subsections (f), (g), (h), and (i)".
(5)  In SECTION 2 of the bill, in added Section 11.201(f), Education Code (page 1, lines 44 and 45), strike "for or against any candidate, measure, or political party".
(6)  In SECTION 2 of the bill, in added Section 11.201(g), Education Code (page 1, line 46), between "(g)" and "An offense", insert the following:
It is an exception to the application of this section that the superintendent:
(1)  used a district facility to host a forum for political candidates or to hold a political party convention;
(2)  used the facility as described by Subdivision (1) at a time that was not during the period between the first day of early voting and the date of the election, if the facility was used as an early voting or election day polling place; and
(3)  allowed equally all candidates for the same office or all political parties, as applicable, the opportunity to use the facility as described by Subdivision (1).
(h)
(7)  In SECTION 2 of the bill, immediately following added Section 11.201(g), Education Code (page 1, between lines 47 and 48), insert the following:
(i)  In this section, "electioneer" has the meaning assigned by Section 11.169.
