AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Actions constituting the offense of invasive visual recording, which is a state jail felony under current law, violate an individual's privacy and expectation of privacy. However, an individual convicted of this crime currently is not required to register as a sex offender. H.B. 1465 aims to provide further protections for victims of this crime by broadening the locations at which certain conduct constitutes the offense of invasive visual recording to include places in which a person has a reasonable expectation of privacy and requiring an individual convicted of this offense to register as a sex offender.

 

H.B. 1465 amends current law relating to the prosecution of the criminal offense of invasive visual recording and the applicability of sex offender registration requirements to that offense.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Article 62.001(5), Code of Criminal Procedure, to redefine "reportable conviction or adjudication."

 

SECTION 2. Amends Section 21.15(a), Penal Code, by adding Subdivision (3-a) to define "place in which a person has a reasonable expectation of privacy."

 

SECTION 3. Amends Section 21.15(b), Penal Code, as follows:

 

(b) Provides that a person commits an offense if, without the other person's consent and with intent to invade the privacy of the other person, the person performs certain actions, including photographing or by videotape or other electronic means recording, broadcasting, or transmitting a visual image of another person in a place in which a person has a reasonable expectation of privacy, rather than in a bathroom or changing room.

 

SECTION 4. Makes application of this Act prospective.

 

SECTION 5. Effective date: September 1, 2025.
