AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

H.B. 1899 amends provisions in the Texas Occupations Code regarding the minimum age requirements for issuing licenses or permits related to public fireworks displays. This bill lowers the minimum age for individuals to be issued such licenses and permits, aligning it with the age requirements for other related permits and licenses. 

 

H.B. 1899 amends current law relating to the required age for a license or permit relating to the conduct of a public fireworks display.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 2154.101(b), Occupations Code, as follows:

 

(b) Prohibits a person who is younger than 18, rather than 21, years of age from being issued a license under Subchapter D (Types of Licenses), Chapter 2154 (Regulation of Fireworks and Fireworks Displays). Deletes existing text prohibiting a person who is younger than 21 years of age from being issued a pyrotechnic operator's license. Deletes existing text providing that the minimum age of a person issued another license under Subchapter D is 18 years of age.

 

SECTION 2. Amends Section 2154.201(a), Occupations Code, as follows:

 

(a)� Prohibits a person who is younger than 18 years of age from being issued a permit, rather than another permit, under Subchapter E (Permit Requirements). Deletes existing text prohibiting a person who is younger than 21 years of age from being issued a public fireworks display permit.

 

SECTION 3. Effective date: September 1, 2025.
