AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
The Texas Health and Human Services Commission (HHSC) requested this statutory clean-up to update outdated training requirements for long-term care facility surveyors. These requirements take away from surveyors' ability to focus on mission-critical activities, including investigations of non-compliance and abuse or neglect of vulnerable individuals.
H.B. 2358 would repeal certain requirements related to training for long-term care facility surveyors, personnel, and Intermediate Care Facility for Individuals with an Intellectual Disability (ICF-IID) program providers.
H.B. �2358 repeals mandates for annual HHSC training on aging in place and retaliation for assisted living staff, an annual ICF-IID provider conference, and a 10-day observation period for new surveyors. This clean-up bill will enable a stronger focus on modernized training opportunities and key resources for the facilities and HHSC.
H.B. 2358 amends current law relating to training required or offered by the Health and Human Services Commission for long-term care facility surveyors, personnel, and providers and ICF-IID program providers.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1.� Repealer: Section 247.066(h) (relating to required annual training for surveyors, facility supervisors, and other staff), Health and Safety Code.
Repealer: Section 533A.066 (Information Relating to ICF-IID Program), Health and Safety Code.
Repealers: Sections 22.039(b-1) (relating to certain required criteria for a basic training program) and (b-2) (relating to waiving a training requirement for certain surveyors who worked in a nursing facility), Human Resources Code.
SECTION 2.� Effective date: upon passage or September 1, 2025.
