AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Transportation Code Section 623.363 establishes the roads on which the Texas Department of Transportation may authorize Hidalgo County Regional Mobility Authority to issue permits for the movement of oversize or overweight vehicles carrying cargo in Hidalgo County. These roads include Spur 29 between its intersection with U.S. Highway 281 and its intersections with Doffin Canal Road.

 

H.B. 2427 would amend the list of roads eligible for oversize or overweight vehicle permits to include Spur 29 between its intersection with U.S. Highway 281 and its intersection with West Doffing Road, rather than Doffin Canal Road. The bill also would add West Doffing Road between its intersection with Spur 29 and its eastern intersection with Doffin Canal Road to the list of eligible roads. The bill also would add State Highway 365 between Farm-to-Market Road 396 and West Military Highway at San Juan Road.

 

By adding additional route designations for the movement of oversized vehicles in Hidalgo County, H.B. 2427 would reduce congestion and ensure that infrastructure planning kept pace with the increased volume of commercial transportation that is expected following the completed expansion of the Pharr-Reynosa International Bridge.

C.S.H.B. 2427 amends current law relating to the issuance of and fee for a permit for the movement of oversize and overweight vehicles on certain routes in Hidalgo County and the use of those fees for the payment of the costs of constructing and maintaining certain of those routes.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 623.363, Transportation Code, by amending Subsection (a) and adding Subsections (a-1) and (c), as follows:

 

(a) Authorizes the Texas Transportation Commission (TTC) to authorize a regional mobility authority to issue permits for the movement of oversize or overweight vehicles carrying cargo in Hidalgo County on certain roads, including Spur 29 between its intersection with U.S. Highway 281 and its intersection with West Doffing Road, rather than with Doffin Canal Road; West Doffing Road between its intersection with Spur 29 and its eastern intersection with Doffin Canal Road; and 365 Tollway between its intersection with Farm-to-Market Road 396 and its intersection with West Military Highway at San Juan Road.

 

Deletes existing text authorizing TTC to authorize a regional mobility authority to issue permits for the movement of oversize or overweight vehicles carrying cargo in Hidalgo County on Doffin Canal Road between its intersection with the Pharr-Reynosa International Bridge and its intersection with Spur 29 or another route designated by TTC in consultation with the authority. Makes nonsubstantive changes.

 

(a-1) Requires the authority authorized under Section 623.363 (Issuance of Permits) to pay from fees collected by the authority under Section 623.364 (Permit Fees) all costs to construct and maintain the route designated under Subsection (a)(9) (relating to West Doffing Road between its intersection with Spur 29 and its eastern intersection with Doffin Canal Road), and any off-system road designated after September 1, 2025.

 

(c) Prohibits the authority authorized under this section from issuing a permit under this section for an oversize or overweight vehicle that is transporting in a cargo tank hazardous material in a quantity requiring placarding by a regulation issued under the Hazardous Materials Transportation Act (49 U.S.C. Section 5101 et seq.).

 

SECTION 2. Amends Section 623.354(a), Transportation Code, to prohibit the maximum amount of the fee that the authority is authorized to collect for permits issued under Chapter 623 (Permits for Oversize or Overweight Vehicles), beginning September 1, 2025, rather than September 1, 2017, from exceeding $250, rather than $200, per trip.

 

SECTION 3. (a) Effective date, except as otherwise provided by Subsection (b): September 1, 2025.

 

(b) Makes application of this Act contingent upon passage of S.B. 2949, 89th Legislature, Regular Session, 2025.
