AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

Many counties, especially rural counties, are struggling to afford to repair county roads, often because those roads were not designed to sustain the high level of commercial vehicle traffic they currently experience. H.B. 2560 seeks to address this issue by creating the Adopt-a-County Road program under which the commissioners court of a county may enter into certain partnership agreements for the repair and maintenance of county roads.

 

In the Adopt-a-County Road program, added to Subchapter A, Chapter 256, Transportation Code, an individual may make a donation, gift, or grant of funds to repair and maintain a section of a county road. The county shall then erect signs as public recognition that funding for the repair and maintenance of the section of county road has been provided by the person. The commissioners court will determine the minimum donation amount that may constitute public sign recognition.

 

H.B. 2560 amends current law relating to creation of the Adopt-a-County Road program.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subchapter A, Chapter 256, Transportation Code, by adding Section 256.011, as follows:

 

Sec. 256.011. ADOPT-A-COUNTY ROAD PROGRAM. (a) Authorizes the commissioners court of a county to enter into a partnership agreement with a person under which:

 

(1) the person is required to make a donation, gift, or grant of funds to repair and maintain a section of a county road; and

 

(2) the county is required to install signs as public recognition that funding for the repair and maintenance of the section of county road has been provided by the person.

 

(b) Requires the commissioners court of a county to determine the amount of a donation, gift, or grant required under Subsection (a)(1) for a person to be recognized under Subsection (a)(2).

 

(c) Provides that funds received by the county through a partnership agreement under this section are authorized to be used only for the repair and maintenance of the county road that is the subject of the agreement, including uses described by Section 256.003 (Use of Revenues From County and Road District Highway Fund).

 

SECTION 2. Effective date: September 1, 2025.
