Transportation

Committee Report (Unamended)

BACKGROUND AND PURPOSE

The bill author has informed the committee that many counties, especially rural counties, are struggling to afford to repair county roads, often because those roads were not designed to sustain the high level of commercial vehicle traffic they currently experience. H.B. 2560 seeks to address this issue by creating the Adopt-a-County Road program under which the commissioners court of a county may enter into certain partnership agreements for the repair and maintenance of county roads.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 2560 amends the Transportation Code to create the Adopt-a-County Road program. The bill authorizes the commissioners court of a county to enter into a partnership agreement with a person under which:

·       the person must make a donation, gift, or grant of funds to repair and maintain a section of a county road; and

·       the county must install signs as public recognition that funding for the repair and maintenance of the section of county road has been provided by that person.

The bill requires the commissioners court of a county to determine the amount of such a donation, gift, or grant required for a person to be publicly recognized. The bill restricts the use of funds received by the county through the partnership agreement to the repair and maintenance of an applicable county road, including authorized uses for the county and road district highway fund.
