AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

This legislation seeks to offer better support for our visiting allied military service members by ensuring their children do not suffer education delays as a result of the differences in Texas school enrollment age and the age of enrollment in the service member's home country.  Enrollment would only be accomplished with the approval and support of the local school district. 

 

H.B. 2757 amends current law relating to a public school policy for establishing age for purposes of admission into the school for certain children of foreign military members.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 25.001, Education Code, by adding Subsection (c-3), as follows:

 

(c-3) Authorizes the board of trustees of a school district, notwithstanding certain provisions of the Education Code, to adopt a policy to allow a person whose parent or guardian is an active-duty member of a foreign military force stationed in this state to establish the person's age for purposes of determining eligibility under those subsections by demonstrating that the person will turn the required age during the school year for which the person is seeking admission.

 

SECTION 2. Provides that this Act applies beginning with the 2025�2026 school year.

 

SECTION 3. Effective date: upon passage or September 1, 2025.
