AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
H.B. 3033 amends the Government Code to require the Department of Public Safety (DPS) to establish and administer a grant program for and disburse funds to nonprofit organizations that provide support to DPS employees, including support for family members of DPS employees who have been killed or injured in the line of duty. This bill restricts the use of grant funds to the following:
� providing assistance and support to DPS employees;
� providing assistance and support to family members of DPS employees who have been killed or injured in the line of duty; and
� memorial signs for DPS employees who have been killed in the line of duty.
This bill subjects those grant funds to audit by the Comptroller of Public Accounts of the State of Texas and requires DPS to establish grant application procedures, guidelines relating to grant amounts, and criteria for evaluating grant applications. This bill creates the nonprofit organizations supporting employees of DPS account as a dedicated account in the general revenue fund of the state treasury and restricts the appropriation of money in that account to DPS for purposes of the grant program established under these provisions.
H.B. 3033 amends the Transportation Code to authorize a person applying for an original or renewal driver's license, commercial driver's license, or personal identification certificate to contribute $3 or more to the grant program for nonprofit organizations supporting DPS employees established under the bill's provisions.
H.B. 3033 amends current law relating to a grant program for nonprofit organizations supporting employees of the Department of Public Safety and authorizes voluntary contributions.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subchapter A, Chapter 521, Transportation Code, by adding Section 521.012, as follows:
Sec. 521.012.� VOLUNTARY CONTRIBUTION FOR GRANT PROGRAM FOR NONPROFIT ORGANIZATIONS SUPPORTING EMPLOYEES OF THE DEPARTMENT OF PUBLIC SAFETY.� (a) Authorizes a person, when the person applies for an original or renewal driver's license or personal identification certificate under Chapter 521 (Driver's Licenses and Certificates), to contribute $3 or more to the grant program for nonprofit organizations supporting employees of the Texas Department of Public Safety (DPS) established under Section 411.013 (Expenditures, Donations, and Appropriations), Government Code.
(b)� Requires DPS to include space on the first page of each application for an original or renewal driver's license or personal identification certificate that allows a person applying for an original or renewal driver's license or personal identification certificate to indicate the amount that the person is voluntarily contributing to the grant program and provide an opportunity for the person to contribute to the grant program during the application process for an original or renewal driver's license or personal identification certificate on DPS's Internet website.
(c) Requires DPS to send any contribution made under this section to the Comptroller of Public Accounts of the State of Texas (comptroller) for deposit to the credit of the nonprofit organizations supporting employees of the DPS account established under Section 411.013, Government Code, not later than the 14th day of each month. Authorizes DPS, before sending the money to the comptroller, to deduct money equal to the amount of reasonable expenses for administering this section.
SECTION 2. Amends Subchapter C, Chapter 522, Transportation Code, by adding Section 522.0297, as follows:
Sec. 522.0297.� VOLUNTARY CONTRIBUTION FOR GRANT PROGRAM FOR NONPROFIT ORGANIZATIONS SUPPORTING EMPLOYEES OF THE DEPARTMENT OF PUBLIC SAFETY.� (a) Authorizes a person, when a person applies for an original or renewal commercial driver's license under Chapter 522 (Commercial Driver's Licenses), to contribute $3 or more to the grant program for nonprofit organizations supporting employees of DPS established under Section 411.013, Government Code.
(b) Requires DPS to include space on the first page of each application for an original or renewal commercial driver's license that allows a person applying for an original or renewal commercial driver's license to indicate the amount that the person is voluntarily contributing to the grant program and provide an opportunity for the person to contribute to the grant program during the application process for an original or renewal commercial driver's license on the DPS's Internet website.
(c) Requires DPS to send any contribution made under this section to the comptroller for deposit to the credit of the nonprofit organizations supporting employees of the DPS account established under Section 411.013, Government Code, not later than the 14th day of each month. Authorizes DPS, before sending the money to the comptroller, to deduct money equal to the amount of reasonable expenses for administering this section.
SECTION 3. Amends Section 411.013, Government Code, by adding Subsections (d), (e), (f), and (g), as follows:
(d) Requires DPS to establish and administer a grant program for and to disburse funds to nonprofit organizations that provide support to employees of DPS, including support for family members of employees of DPS who have been killed or injured in the line of duty.
(e) Provides that grant funds are authorized to be used only for providing assistance and support to employees of the department or family members of employees of DPS who have been killed or injured in the line of duty or memorial signs for employees of DPS who have been killed in the line of duty.
(f) Requires DPS to establish grant application procedures, guidelines relating to grant amounts, and criteria for evaluating grant applications.
(g) Provides that the nonprofit organizations supporting employees of the DPS account is created as a dedicated account in the general revenue fund of the state treasury. Provides that money in the account is authorized to be appropriated only to DPS for purposes of the grant program established under Subsection (d). Provides that funds disbursed under Subsection (d) are subject to audit by the comptroller.
SECTION 4.� Makes application of this Act prospective to January 1, 2026.
SECTION 5.� Effective date: September 1, 2025.
