AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Texas State Soil and Water Conservation Board (TSSWCB) is required to implement a program to eradicate Carrizo cane along the Rio Grande River due to the plant's invasive nature, and negative effects on border security efforts. The program references "a comprehensive environmental management system," but to date has primarily addressed Carrizo cane. To effectively implement a comprehensive plan, other types of harmful vegetation must also be included for removal.

 

H.B. 3479 would direct the agency to develop and implement a broader Rio Grande Vegetative Management Program aimed at managing, rather than eradicating, Carrizo cane and other invasive vegetation.

 

H.B. 3479 amends current law relating to the Rio Grande vegetative management program.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 201.0225, Agriculture Code, as follows:

 

Sec. 201.0225. New heading: RIO GRANDE VEGETATIVE MANAGEMENT PROGRAM. Requires the State Soil and Water Conservation Board to develop and implement the Rio Grande vegetative management program to manage, rather than eradicate, Carrizo cane and other noxious vegetation that impedes border security along the Rio Grande River. Makes a nonsubstantive change.

 

SECTION 2. Effective date: upon passage or September 1, 2025.
