AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
H.B. 3546 amends Section 11.09(e) of the Education Code and Section 41.0052 of the Election Code to allow school districts to move officer elections to November. This change would synchronize school board elections with city and general elections.
H.B. 3546 amends current law relating to the authority of an independent school district to change the date of the general election for officers.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 11.059(e), Education Code, as follows:
(e) Authorizes the board of trustees of an independent school district, not later than December 31, 2030, rather than December 31, 2023, to adopt a resolution changing the length of the terms of its trustees until the date the November election is canvassed. Provides that this subsection expires January 1, 2036.
SECTION 2. Amends Section 41.0052, Election Code, by amending Subsection (a-1), as added by Chapter 985 (S.B. 2620), Acts of the 88th Legislature, Regular Session, 2023, and adding Subsection (f), as follows:
(a-1) Deletes existing text authorizing an independent school district that holds its general election for officers on a date other than the November uniform election date, notwithstanding Subsection (a) (relating to authorizing the governing body of a political subdivision that holds its general election for officers on a date other than the November uniform election date to change to the uniform date not later than a certain time), to change the date on which it holds its general election for officers to the November uniform election date.
(f) Authorizes the governing body of an independent school district that holds its general election for officers on a date other than the November uniform election date to change the date on which it holds its general election for officers to the November uniform election date.
SECTION 3. Repealers: Sections 11.059(f) (relating to authorizing adoption of a resolution changing the length of the terms of the board of trustees of a school district under certain conditions) and 11.059(g) (relating to the expiration date of certain subsections), Education Code.
Repealer: Section 41.0052(a-1) (relating to authorizing the governing body of an independent school district in certain counties that holds its general election for officers on a date other than the November uniform election date to change to the uniform date), Election Code, as added by Chapter 1160 (S.B. 1131), Acts of the 88th Legislature, Regular Session, 2023.
SECTION 4. Provides that, to the extent of any conflict, this Act prevails over another Act of the 89th Legislature, Regular Session, 2025, relating to nonsubstantive additions to and corrections in enacted codes.
SECTION 5. Effective date: upon passage or September 1, 2025.
