AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Current law requires the comptroller and each state agency making a purchase using the open market purchasing procedure to solicit bids by direct mail, telephone, telegraph, facsimile transmission, or online electronic transmission. Telegraphs, however, are not an available or practical means of soliciting bids because telegraphs are antiquated technology that are no longer used as a communication method. H.B. 3623 seeks to reform that provision in current law by removing the telegraph as an authorized means of soliciting bids.
H.B. 3623 amends current law relating to the manner of solicitation of bids for certain purchases by the comptroller of public accounts and state agencies.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 2156.063, Government Code, to delete existing text requiring the Comptroller of Public Accounts of the State of Texas and each state agency making a purchase to solicit bids under Subchapter B (Open Market Purchase Procedure) by telegraph, and to make nonsubstantive changes.�
SECTION 2. Effective date: September 1, 2025.
