AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Department of Public Safety (DPS) commercial vehicle enforcement office in Woodville, Texas, currently operates, under a memorandum of understanding, out of a building owned by the Texas Department of Transportation (TxDOT). After consultation with DPS and TxDOT, both parties have agreed that transferring the building from TxDOT to DPS would better serve both entities in the long run. H.B. 3751 seeks to address this issue by providing for the transfer not later than November 30, 2025.

 

H.B. 3751 amends current law relating to the transfer of certain real property from the Texas Department of Transportation to the Texas Department of Public Safety.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. (a) Requires the Texas Department of Transportation (TxDOT), not later than November 30, 2025, to transfer the real property described by Section 2 of this Act to the Texas Department of Public Safety, including the improvements affixed to the property.

 

(b) Requires TxDOT to transfer the property by an appropriate instrument of transfer that describes the property to be transferred by metes and bounds.

 

(c) Provides that Chapter 202 (Control of Transportation Assets), Transportation Code, and Sections 31.1571 (Governor's Report), 31.158 (Real Estate Transactions Authorized by Legislature), and 31.159 (First Option to Purchase), Natural Resources Code, do not apply to the transfer of real property authorized by Subsection (a) of this section.

 

SECTION 2. Provides that the real property to which Section 1 of this Act applies is described in a certain manner.

 

SECTION 3. Effective date: September 1, 2025.
