AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Residents in neighborhoods near schools have raised concerns about commercial bus services, such as Greyhound, contributing to unsafe conditions, including serving as gathering points for drug activity and other public safety issues. Given the number of complaints, commercial bus operators should be responsible for engaging with the community and demonstrating transparency before beginning operations at a new stop.
H.B. 3966 amends the Business & Commerce Code to require commercial passenger bus services to provide written notice at least 90 days before beginning operations. The notice must be sent to residents living within a one-mile radius of the planned bus stop, terminal, or facility. It must include the location's address and a description of the site and may be delivered by mail. There is no opposition identified at this time and there is no cost associated with installation.
H.B. 3966 amends current law relating to requiring owners or operators of commercial passenger bus services to provide certain notifications to residents concerning operations.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Subtitle C, Title 5, Business & Commerce Code, by adding Chapter 121, as follows:
CHAPTER 121. REGULATION OF COMMERCIAL PASSENGER BUS SERVICES
Sec. 121.001. DEFINITION. Defines "commercial passenger bus service."
Sec. 121.002. NOTIFICATION OF NEW BUS STOPS, TERMINALS, OR OTHER INSTALLATIONS. (a) Requires the owner or operator of a commercial passenger bus service, at least 90 calendar days before the date a commercial passenger bus service begins operating a new bus stop, terminal, or other installation located in this state, to provide written notice of the stop, terminal, or installation to residents who live within one mile of the stop, terminal, or installation.
(b) Requires that the notice required by this section be delivered by mail and include the address or a description of the location of the new bus stop, terminal, or other installation.
SECTION 2. Effective date: September 1, 2025.
