AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
H.B. 4145 amends current law relating to the timely billing of health care services related to a personal injury claim.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 146.002, Civil Practice and Remedies Code, by amending Subsections (a) and (d) and adding Subsection (c-1), as follows:
(a) Requires a health care service provider, except as provided by Subsection (b) (relating to requiring the health care service provider to bill the issuer of the plan not later than a certain time) or (c) (relating to requiring the health care service provider to bill the third party payor not later than a certain time) and subject to Subsection (c-1), to bill a patient or other responsible person for services provided to the patient not later than the first day of the 11th month after the date the services are provided.
(c-1) Authorizes the provider, if a health care service provider provides services to a patient that are related to a personal injury claim for which the patient is represented by an attorney and unless otherwise directed by the patient or other responsible person, to satisfy the requirements of Subsection (a) by submitting the bill to the patient's attorney not later than the first day of the 11th month after the date the services are provided.
(d) Provides that, for purposes of Section 146.002 (Timely Billing Required), the date of billing is the date on which the health care service provider's bill is mailed to certain� entities, including mailed to the patient, responsible person, or attorney representing the patient, as applicable, postage prepaid, at the address of the patient, responsible person, or attorney representing the patient as shown on the health care service provider's records. Makes nonsubstantive changes.
SECTION 2. Makes application of this Act prospective.
SECTION 3. Effective date: September 1, 2025.
