BACKGROUND AND PURPOSE
Most elected prosecutors with felony jurisdiction are subject to the Professional Prosecutors Act, which provides pay equity with district judges in exchange for prohibiting the prosecutor from the private practice of law. H.B. 4266 makes the Professional Prosecutors Act applicable to the county attorney of Fayette County, who performs the duties of a district attorney in that county.

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
H.B. 4266 amends the Government Code to make the Professional Prosecutors Act applicable to the county attorney of Fayette County, who performs the duties of a district attorney in that county.
