AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Many chemical companies incorporate biobased waste materials, which would otherwise be discarded or landfilled, as alternatives to fossil-based feedstocks to meet customer demands, but these companies currently do not receive credit for doing so.
H.B. 4413 seeks to provide for mass balance accounting for biobased feedstocks to track biobased raw materials through production processes and accurately attribute biobased content to end products for the purpose of enabling Texas manufacturers to use existing infrastructure efficiently and scale up production to meet customer demands.
H.B. 4413 amends current law relating to mass balance attribution of renewable biomass feedstocks used to produce renewable chemicals.
RULEMAKING AUTHORITY
Rulemaking authority previously granted to the Texas Commission of Environmental Quality is modified in SECTION 2 (Section 361.4215, Health and Safety Code) of this bill.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 361.421, Health and Safety Code, by adding Subdivisions (8-a) and (8-b) to define "renewable biomass" and "renewable chemical."
SECTION 2. Amends Section 361.4215, Health and Safety Code, as follows:
Sec. 361.4215.� MASS BALANCE ATTRIBUTION. Requires the Texas Commission on Environmental Quality by rule to identify third-party certification systems for mass balance attribution that may be used for the purposes of certain provisions of this section, including Subsection (8-b) (relating to defining "renewable chemical").
SECTION 3. Requires TCEQ, as soon as practicable after the effective date of this Act, to adopt rules necessary to implement the changes in law made by this Act.
SECTION 4.� Effective date: September 1, 2025.
