AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The bill author has informed the committee that plans are underway in Williamson County to construct a new courthouse and that, for convenience, county officials have requested the ability to post meeting agendas both digitally and physically. H.B. 5534 seeks to fulfill this request by specifying that the authorization for a county clerk to post notices by electronic display instead of posting a physical document includes county commissioners court meeting agendas. 

 

H.B. 5534 amends current law relating to the electronic posting of notices and agendas for meetings of the commissioners court of a county.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 82.051(b), Local Government Code, to authorize a county clerk to post an official and legal notice, including the agenda for a meeting of the commissioners court, by electronic display instead of posting a physical document.�

 

SECTION 2. Amends Section 551.049, Government Code, as follows:

 

Sec. 551.049.� COUNTY GOVERNMENTAL BODY:� PLACE OF POSTING NOTICE.� Requires a county governmental body to post notice of each meeting in certain places, including the option of an electronic display as provided by Section 82.051 (Electronic Display of Official and Legal Notices by County Clerk), Local Government Code. Makes nonsubstantive changes.

 

SECTION 3. Makes application of Section 551.049, Government Code, as amended by this Act, prospective.

 

SECTION 4.� Effective date: September 1, 2025.
