BACKGROUND AND PURPOSE
The 88th Texas Legislature created the Texas Energy Fund to support the construction, maintenance, modernization, and operation of electric generating facilities and appropriated $5 billion to be used to provide grants and loans to projects through that fund. Texans approved the creation of the fund through a constitutional election in November 2023. C.S.H.J.R. 218, along with its enabling legislation, would allow money in the fund to be used to finance energy efficiency projects that benefit retail electric customers.

It is the committee's opinion that this resolution does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

It is the committee's opinion that this resolution does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
C.S.H.J.R. 218 proposes an amendment to the Texas Constitution to authorize the use of money in the Texas Energy Fund to be administered and used by the Public Utility Commission of Texas to finance energy efficiency projects conducted to benefit retail electric customers.

ELECTION DATE
The constitutional amendment proposed by this joint resolution will be submitted to the voters at an election to be held November 4, 2025.

COMPARISON OF INTRODUCED AND SUBSTITUTE
C.S.H.J.R. 218 differs from the introduced only by making minor changes to the ballot language for the constitutional amendment.
