BACKGROUND AND PURPOSE

 

The bill sponsor has informed the committee that current law erroneously directs the executive director of the Texas Department of Licensing and Regulation (TDLR) to administer and enforce the entire chapter of the Health and Safety Code regulating radioactive materials and other sources of radiation, which falls under the purview of other agencies, instead of focusing solely on the relevant subchapter regulating laser hair removal. The bill sponsor has further informed the committee that the law includes redundant provisions requiring TDLR to include warning signage information in laser hair removal facility license applications despite the availability of more efficient communication methods. S.B. 748 seeks to clarify the executive director's enforcement authority and update the statutes regarding warning signs for laser hair removal facilities.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 748 amends the Health and Safety Code to replace the requirement for the executive director of the Texas Department of Licensing and Regulation (TDLR) to administer and enforce statutory provisions relating to radioactive materials and other sources of radiation with a requirement for the executive director to administer and enforce statutory provisions relating to laser hair removal.

 

S.B. 748 repeals Sections 401.516(b) and (c), Health and Safety Code, which do the following:

·       require the Texas Commission of Licensing and Regulation to adopt rules specifying the size, content, and design of the warning sign that a laser hair removal facility must post, with wording listing the potential dangers involved; and

·       require TDLR to include with an application for a laser hair removal facility license and an application for renewal of such a license a description of the design standards required for the warning sign.

 

EFFECTIVE DATE

 

September 1, 2025.
