BACKGROUND AND PURPOSE

 

The State Office of Administrative Hearings conducts licensure hearings for the Texas Department of Licensing and Regulation. However, the bill sponsor has informed the committee that there are antiquated provisions in existing law authorizing hearings officers designated by the Texas Commission of Licensing and Regulation to conduct hearings under the Texas Electrical Safety and Licensing Act. S.B. 764 seeks to address this issue by removing obsolete language from the code.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 764 amends the Occupations Code to remove the provision authorizing a hearing under the Texas Electrical Safety and Licensing Act to be conducted by a hearings officer designated by the Texas Commission of Licensing and Regulation. The bill applies only to a hearing that commences on or after the bill's effective date. A hearing that commences before the bill's effective date is governed by the law in effect on the date the hearing commenced, and the former law is continued in effect for that purpose.
