BACKGROUND AND PURPOSE
The bill sponsor has informed the committee that H.B. 2912, passed by the 77th Texas Legislature in 2001, changed the name of the Texas Natural Resource Conservation Commission to the Texas Commission on Environmental Quality via the sunset review process, with the name change taking effect on January 1, 2004. The bill sponsor has also informed the committee that there are, however, many references to the previous name throughout statute. S.B. 766 seeks to address this issue by replacing these references with references to the current name.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS
S.B. 766 amends the Agriculture Code, Government Code, Health and Safety Code, Local Government Code, Natural Resources Code, Occupations Code, Penal Code, Parks and Wildlife Code, Special District Local Laws Code, Tax Code, Transportation Code, and Water Code to replace references to the Texas Natural Resource Conservation Commission with references to the Texas Commission on Environmental Quality (TCEQ) and to establish that, effective January 1, 2004, a reference in law to the Texas Natural Resource Conservation Commission is a reference to the TCEQ.
S.B. 766 repeals Section 57.001(3), Water Code.
