BACKGROUND AND PURPOSE

 

Current law requires the executive director of the Texas Department of Licensing and Regulation to serve as an ex-officio member of the Board of Boiler Rules. The bill sponsor has informed the committee that the position is a ceremonial role that is outdated and inaccurately defines a board majority as five votes, which is incorrect, given that the board comprises 11 members. Additionally, current law allows 30 days for boiler certificate inspection reports to be submitted, delaying the notification of potential safety hazards. S.B. 917 seeks to streamline board operations and improve public safety through faster reporting.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

S.B. 917 amends the Health and Safety Code in provisions relating to boiler registration and inspection to change the deadline from not later than the 30th day after the date on which a certificate boiler inspection is performed by an authorized inspector to not later than the 10th day after that date on which the inspection agency employing the authorized inspector must file a report with the executive director of the Texas Department of Licensing and Regulation (TDLR) in the manner specified by the executive director.

 

S.B. 917 repeals Sections 755.011(d) and 755.018, Health and Safety Code, relating to the executive director of TDLR serving as an ex officio Board of Boiler Rules member and the vote required for a board decision to take effect.

September 1, 2025.
